My name is Amanda, I am a 15yr old, Freshman, at Williamsfeild High, in Arizona. I just recently started dating my boyfriend, JD. JD is 18 years old, and he is a senior at my school. My Mom does not have any issue with us being together. Before things get too serious in our relationship, I want too make sure that he can't get in any trouble for being with me. So basicaly what I am asking is: Can he get in any trouble with the law because of me? And if I consent to having sex with him, will he get in trouble for that?

So your mom is fine with you having sex with an 18 year old guy? Is your life so boring or empty that you can't wait a few years to get serious with some guy? Aren't there things that you want to do or accomplish? I suppose I just don't understand the need for having sex at your age. And, yes--it's called statutory rape, so he could get in trouble. I wonder why he can't find someone his own age or be mature enough to realize you might just be a little young. But then, I am over 30, so what do I know?

You are not old enough to have consent so yes, if you have sex he can get arrested. Men these days have issues. They need to date people their own age and not little girls way younger. Basically when a man is a certain amount of years older and the girl is still under 16 she is considered still a child that even if you consent your consent doesn't count because you are too young to know any better. So if your parents ever get mad at him or whatever they can charge him with statutory rape.

Well he is only 3 years older than you wich in my opinion is not a big deal at all. Some states have a 4 year law, but the truth is if you have sex with him YES he can be charged with statutory rape even with your consent, this goes for anyone 18 and above even if you were only a year younger(in my opinion is stupid). but you are young and in my opinion the best thing to do is not to sleep with him, because can you really see yourself with him for the rest of your life? this kind of thing happens all the time so most people dont worry about it too much, and you can make your own choices...just think about the consequences and weigh them out, but yes there is a risk.

He will only get in trouble if you or someone like your mom (or any other adult) gets him in trouble. It is against the law for the two of you to have sex, but the cops won't come after you for it unless someone else takes issue and brings it up to them.

I wouldn't recommend having sex at your age though, even if you are mature. Sex is better left for later, because whoever you have sex with will end up meaning a lot to you, and it will be all the more worse when it's over. You should wait to have sex until you are in love. And when that happens, you'll know (trust me, if you've only been together for a few months, it's not love, even if you really, really, really, like him).

In the state of Arizona you must be 18 years old to consent to have sex. Should you and your boyfriend have sex and get caught (or if one of your parents decides they don't like the kid and report him) he can be charged with statutory rape.

To be more specific: Arizona has classified sex with minors (who are between the ages of 15-17) as a class 6 felony. A class 6 felony is a one year stint in prison for the first offense.

Also under A.R.S. § 13-382 he will have to register as a sex offender.

In Arizona:

going by the website below, since he's more than 2 years older, sex wouldn't be legal.

I'm not a legal expert at all, but I figure if no one else found out, there wouldn't be much the police could do about it.

To go off on a tangent, they have these laws for a reason. I can't tell you how to live your life, but don't rush into things. My gut says it's a little sketchy for him to be dating a 15 year old, but I could easily be wrong.

Your boyfriend JD can get in trouble, but only if he does something to you that you do not like. Technically the only way he can get in trouble is if you tell on him since you are just a minor. JD just has to be careful with what he does with you and around you.

Yes, and forever he will have to register as a sex offender. He will have to report to every employer what the charges were for til the day he dies. He won't be able to live a normal life. Jail, possible prison ( they would make lunch meat out of your boyfriend). It doesn't matter if both of your parents are okay with it, if the athoritys step in, it is out of all of you hands and he will be the one to suffer the consequences not you. You will be able to freely go to college, and make something out of your life, no questions asked. You would be able to get married without mentioning to your husband that you are a registered sex offender, and you will be able to pick you kids up from school where he won't even be aloud to do that. It wouldn't be fare to him or to everyone involved in his future. You both may get married some day, but having to register as a sex offender wouldn't go away. You really need to think about what your actions might do to someone you care deeply for.

Amanda, I'm no expert on this but I think so. Being "you" (a person) becomes an adult at 18, and you're still considered and are a "child." If anything "serious" (sexually) happens, he'll have to register as a Sex Offender. I'm not saying this to scare you, I'm telling you what I know about it. Good luck!!!

As you can see, there is no "age-gap" provision in the state of Arizona.

He cannot get in trouble with being with him, you cannot have sex with him because that will be statuatory rape, which is rape of a minor, even if you are ok with having sex. When you turn 18 then you are fine.

Probably. He could be prosecuted for statutory rape, sent to prison and labeled a sex offender for the rest of his life. He may be restricted in the places he's allowed to live and may have real trouble finding a job. He may be barred completely from getting the job he wants. His life could be ruined.
